SHEIN Customized Product Terms and Conditions

As used in these terms and conditions, “SHEIN” , the "Company" , "we" , "us" and "our" shall refer to Fashion Choice Pte. Ltd., and its affiliates and "you" or "your" shall refer to the individual or entity submitting images, designs, text or other content ("Content") to be incorporated into customized products on hk.shein.com or purchasing such products. If you want to purchase customized products on hk.shein.com, you must accept these terms and conditions without change.
BY CLICKING THE 'CUSTOMIZE NOW' BUTTON OR PLACING YOUR ORDER FOR CUSTOMIZED PRODUCTS, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING BUT NOT LIMITED TO SHEIN PRIVACY POLICY , SHEIN H.K. TERMS OF USE AS MODIFIED FROM TIME TO TIME.
  • 1. Content: You can submit your own Content or select from a gallery of designs and images to create customized products. You may only submit Content that complies with SHEIN H.K. TERMS OF USE , which prohibit pornographic, libelous, defamatory, tortious, obscene, or racially, ethnically or otherwise objectionable content and applicable laws (including intellectual property laws). We expressly reserve the right to reject any non-compliant materials.
  • 2. License Grant for Your Content: You hereby grant to SHEIN, its affiliates and sublicensees (including third parties who provide customized products and related services)(collectively, the "Customization Providers")a worldwide, nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right, in connection with the production of and your purchase of customized products, to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display the Content you submit (including the names and likenesses of any individuals that appear in the Content).
  • 3. Representations, Warranties and Indemnities: You represent and warrant that you have the right to grant the licenses set forth in these terms and conditions; that the use of this Content by the Customization Providers will not violate, misappropriate or infringe any intellectual property right or otherwise cause injury to any person or entity; and that you will defend, indemnify and hold harmless the Customization Providers from and against any loss, damage, judgment, settlement, expense, interest, and any other liability(including reasonable attorneys' fees and costs) related to or arising out of any third party allegation, claim, lawsuit or proceeding (a "Claim") to the extent such Claim is based on a breach of these terms and conditions;
  • 4. Prohibition on Resale: Reselling customized products, offering for sale, or otherwise making available customized products to anyone, in any place, in whole or in part, directly or indirectly, via online or offline channels, is prohibited. The customization service is for purchase of products use only and you agree not to use the Service for business operation as a product provider or for any business enterprise or purpose, unless specifically authorized in writing by SHEIN. For avoidance of potential risks, you shall not order more than 10 customized products at one time. And violation of the resale prohibition may result in claims for monetary damages and legal liabilities against you.
  • 5. SHEIN Intellectual Property: You may not use SHEIN's intellectual property in any manner without SHEIN's prior written consent. These terms and conditions and your purchase of customized products do not grant you any right in such intellectual property (including any photographs, illustrations, graphics, text, designs or images made available to you for customization).
  • 6. Returns: Customized products CANNOT be Returned or Exchanged, only if we provide wrong customized products (e.g. your receipt of the customized products with patterns which are not from you submission).
  • 7. Modifications: We may modify these terms and conditions at our sole discretion by posting the modified terms on the SHEIN.com website. Your continued purchase of customized products on SHEIN.com after the effective date of the modified terms constitutes your acceptance of the modified terms.

  • 3. 聲明、保證和賠償： 您聲明並保證您有權授予本條款中規定的許可；客製化服務提供者對該內容的使用不會侵犯任何智慧財產權或對任何人或實體造成損害；您將為客製化服務提供者辯護、賠償並使其免受任何損失、損害、判決、和解、費用、利息和任何其他責任（包括合理的律師費和費用），這些責任與任何第三方指控、索賠、訴訟或程序（以下稱「索賠」）有關或由此引起，前提是該索賠基於您違反本條款。
